Just married in Wisconsin? Congratulations. Wisconsin runs its name change in a strict order, and the DMV enforces it: Social Security first, then a 48-hour wait, then the DMV. Get that sequence wrong and you will make the trip twice. Wisconsin also sets two separate legal deadlines that almost no guide mentions. Here is the whole process, with real fees.
Cost & Time at a Glance
| Cost | About $34 for the core steps. The vehicle document is free, and Social Security costs nothing. |
| Time | Social Security is often online, then a 48-hour wait before the DMV. Your new licence arrives in 7 to 10 business days. |
| Deadline | 30 days to apply for a new licence (Wis. Stat. 343.22(3)) and 10 days to notify the DMV in writing about your vehicle registration (Wis. Stat. 341.335). |
Which Married Names Can You Take in Wisconsin?
Wisconsin makes this easy: your marriage certificate is itself a legal name-change document, so there is no court hearing and no petition for a married name. You can take your spouse’s surname, or use a hyphenated surname built from both of your names, on the strength of that certificate alone. Wisconsin also recognises the long-standing common-law right to change a name through consistent and continuous use, provided it is not done for a fraudulent purpose, which is the legal reason the certificate is enough here.
Where the court does come in is a name the marriage does not create: a first-name change, or a brand-new surname belonging to neither spouse. That runs under Wis. Stat. 786.36 as a petition to the circuit court in the county where you live (form CV-450, with instructions in CV-490). Budget for it: the statewide circuit court filing fee for a name change is $164.50. Set against a $20 certified copy, that is a strong argument for staying inside what the marriage certificate already covers.
Step 1: Order Certified Copies of Your Marriage Certificate
Everything downstream needs this document. Wisconsin keeps marriage records with the Register of Deeds in each of its 72 counties, and the pricing has a shape worth exploiting:
$20.00 for the first certified copy, then just $3.00 for each additional copy ordered at the same time. This is set by Wis. Stat. 69.22, so it is the same at every county Register of Deeds and at state Vital Records.
That $3 add-on is the single best value in the whole process. Two copies cost $23, not $40. Order two or three in one go: Social Security wants to see one, and having a spare means a lost document never restarts your name change.
Where to order: your county Register of Deeds, or the state DHS Vital Records office. One warning for Milwaukee: the Milwaukee City Health Department does not issue marriage records for Milwaukee County events, so go to the county Register of Deeds instead.
Step 2: Update Social Security (Do This First)
In Wisconsin this is not just a recommended order, it is a requirement. The DMV verifies your new name electronically against Social Security’s records, so the licence cannot be changed until Social Security has processed the change.
Good news: Wisconsin is one of the states where you can do this online, through a personal my Social Security account, without setting foot in an office. The eligibility rules are specific, and one of them is easy to miss: you must hold a Wisconsin driver licence (Wisconsin is a driver-licence-only state for this service), be 18 or older, be a U.S. citizen with citizenship on your Social Security record, have a U.S. mailing address, and be changing only your last name because of the marriage. If any of that does not fit, file Form SS-5 in person or by mail instead. Either way it is free. The full federal process is on our Social Security name change guide.

Step 3: Change Your Wisconsin Driver License
Work this list in order. Wisconsin calls it the DMV, and you must go in person to a DMV customer service center:
- Change your name with Social Security first (online if you qualify).
- Wait 48 hours. Wisconsin DMV needs that window to verify your new name electronically. Turning up sooner is the most common wasted trip in the state.
- Complete form MV3001 for a driver licence, or MV3004 for an ID card.
- Bring proof of identity and proof of the name change. Your certified marriage certificate is accepted, and it is what links the name on your Social Security card to your new name. You may also be asked for proof of name and date of birth, Wisconsin residency, and legal presence.
- Surrender your current licence or ID card. Wisconsin takes the old card at the counter, so do not plan anything that needs photo ID immediately afterwards.
- Pay $14, the standard duplicate and replacement fee. There is no free name-change option.
- Keep the paper receipt. It is valid identification until your new card arrives in 7 to 10 business days.
The 30-day rule nobody mentions. Wis. Stat. 343.22(3) requires you to apply for a duplicate licence showing your correct full legal name within 30 days of a name change. The DMV’s own name-change page does not say this anywhere, which is exactly why so many Wisconsin newlyweds miss it.
Getting a REAL ID at the same time? Bring the standard REAL ID document set plus proof of every name change between your birth certificate and today. There is one shortcut: if you hold a valid, unexpired U.S. passport in your current name, that covers the entire chain on its own.
Step 4: Your Vehicle (Free, But There Is a Catch)
Wisconsin splits this into two things, and most guides only tell you about the optional half:
- Required: written notice within 10 days. Wis. Stat. 341.335 says a registrant whose name changes by marriage must notify the DMV in writing within 10 days, giving the former name, the new name, and the plate numbers. This is a legal obligation, and it is a tighter deadline than the licence.
- Optional: the paper documents. Changing your licence already updates the DMV’s base record, so you are not required to get a corrected title, Confirmation of Ownership, or registration document.
- If you do want the paperwork to match before renewal, file form MV1020 (Title/Registration Correction Request) and send in your current title or Confirmation of Ownership. There is no charge by mail.
Where to Get Your Marriage Certificate in Wisconsin
Because Wis. Stat. 69.22 fixes the fee statewide, you will pay the same $20 first copy and $3 per additional copy wherever you go. What changes is which office you visit. These are the Register of Deeds offices for Wisconsin’s largest counties:
| County | County seat | Certified marriage copy |
|---|---|---|
| Milwaukee | Milwaukee | $20 first, $3 each additional (Register of Deeds, not the City Health Department) |
| Dane | Madison | $20 first, $3 each additional |
| Waukesha | Waukesha | $20 first, $3 each additional |
| Brown | Green Bay | $20 first, $3 each additional |
| Racine | Racine | $20 first, $3 each additional |
| Outagamie | Appleton | $20 first, $3 each additional |
| Winnebago | Oshkosh | $20 first, $3 each additional |
| Kenosha | Kenosha | $20 first, $3 each additional |
| Rock | Janesville | $20 first, $3 each additional |
| Marathon | Wausau | $20 first, $3 each additional |
Wisconsin Name Change Mistakes to Avoid
“I’ll go to the DMV on my way home from Social Security.”
The most expensive mistake in Wisconsin. The DMV cannot verify your new name until Social Security has processed it, and that takes 48 hours. Go two days later and you go once.
“There’s no real deadline.”
There are two. 30 days to apply for a corrected licence (Wis. Stat. 343.22(3)), and 10 days to notify the DMV in writing about your vehicle registration (Wis. Stat. 341.335). The vehicle one is shorter, and it is the one people never hear about.
“I’ll just order one certified copy.”
Extra copies are $3 in the same order against $20 for the first. Ordering a second one later costs you $20 all over again. Buy two or three now.
“I can change my name with Social Security online, everyone can.”
In Wisconsin the online service is limited to driver licence holders who are 18 or older, U.S. citizens, and changing only a last name. If you carry a state ID rather than a licence, it is Form SS-5 the old-fashioned way.
“They’ll give my licence back after they take the photo.”
They will not. Wisconsin surrenders your old card. You leave with a paper receipt that works as ID for the 7 to 10 business days until the new licence arrives.
“I need a court order to hyphenate.”
You do not. A hyphenated surname built from both spouses’ names is covered by the marriage certificate. The $164.50 court petition is for a first-name change or an entirely new surname.
Update Your Voter Registration
Do the DMV first. MyVote Wisconsin checks your name against DMV records, so online registration under your new name only works once the DMV change has gone through. Trying to do it earlier is the second-most-common Wisconsin ordering mistake.
Deadlines: online and mail registration close 20 days before the election. After that you can still register in person at your municipal clerk’s office until 5:00 pm the Friday before Election Day.
What a Wisconsin Name Change Costs and How Long It Takes
The honest math for a standard married name change in Wisconsin:
| Step | Wisconsin cost |
|---|---|
| Certified marriage certificate | $20 first copy, $3 each additional in the same order |
| Social Security card | Free (online for most Wisconsin licence holders) |
| Driver licence replacement | $14 |
| Vehicle registration notice | Free (written notice, required within 10 days) |
| Corrected title or registration document | Free by mail, and optional |
| State income tax record (Form P-706) | Free |
| Voter registration | Free |
Core out-of-pocket is about $34 for one certified copy and the licence, or $37 with a spare copy. That makes Wisconsin one of the cheaper states for a married name change, largely because the vehicle paperwork costs nothing.
Time: Social Security online is same-day, then a 48-hour wait, then a single DMV visit; the new licence lands in 7 to 10 business days. A passport update is optional and federal: free using Form DS-5504 if your passport was issued less than a year ago, and routine processing currently runs 4 to 6 weeks (2 to 3 weeks expedited, for an extra $60). See our passport name change guide.
Wisconsin State Taxes
Wisconsin has a state income tax, and unlike some states it does not simply inherit your new name from Social Security. The Department of Revenue asks you to tell it directly: file Form P-706, Taxpayer Information Change Request, by mail or fax. Include your name, your tax account number or the last four digits of your Social Security number, your spouse’s name, and the details of the name change. There is no fee. Doing this before you file keeps your return matching the name on your Social Security record, which is what prevents a processing delay or a bounced refund.
Licensed Professional? Update Your Board
- Most professions, including nursing: the Department of Safety and Professional Services (DSPS). Log in to LicensE and choose Amendments, then Request for Amendment. You have 30 days to notify DSPS of a name change (Wis. Stat. 440.11), and the Board of Nursing states the same 30-day window.
- Teachers: the Department of Public Instruction. Start at the DPI name and address change page for the current requirements.
That is the whole Wisconsin list. The sequence is what matters here more than in most states: Social Security, wait two days, DMV, then everything else. Our name change checklist covers the remaining banks, cards and accounts, and you can compare how other states handle it if you have moved recently.
